The original complaint that was filed in 2015 has been amended and re-written from scratch.
This new amended complaint contains four parts:
- Violation of the Separation of Powers Doctrine and Ultra Vires Conduct
- Arbitrary and Capricious Regulation
- Federal Preemption
- Violation of the First Amendment of the U.S. Constitution and the New York Constitution
The State has something like 30 days to submit their motion to dismiss. We'll answer that motion and then we go in front of the judge on August 31, 2017.
